Can Social Security change the amount of an authorized fee?
Yes, it can be changed after an administrative review. A claimant, representative, affected auxiliary beneficiary, or the decision maker in a fee agreement case, who is dissatisfied with the fee amount authorized may ask Social Security to change the fee. Social Security performs an administrative review of a fee authorization upon receipt of a written request, timely filed by a proper party.
When these conditions are met, Social Security will notify all other parties of the request for administrative review of the fee amount and give each party the opportunity to submit written information responding to the request. Then Social Security assesses whether the fee is reasonable compensation for the specific services provided. Finally, Social Security decides whether to affirm or modify (increase or decrease) the fee amount and notifies the parties of its decision.
